All services offered are subject to availability and agreement. Quotes provided are estimates only and may vary based on project scope and material pricing.

Limitation of Liability

Choyo is not liable for any direct or indirect damages arising from your use of this site or reliance on its content.

Section 1 – Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any viruses, worms, or other destructive code. A breach of any of these Terms will result in immediate termination of your access to the Service.

Section 2 – General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks and may be adapted to comply with technical requirements. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without express written permission from us.

Section 3 – Accuracy of Information

The information provided on this site is for general informational purposes only. We are not responsible if such information is inaccurate, incomplete, or outdated. Your reliance on the material is at your own risk. Historical information is provided as a reference only and may not be current.

Section 4 – Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any Service or product at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Section 5 – Products or Services

Certain products or services may be available exclusively online and are subject to return or exchange only as provided in our Return Policy. We make every effort to display accurate colors and images but cannot guarantee that your device’s display will be accurate. We reserve the right to limit sales and quantities, and to discontinue products without notice.

Section 6 – Billing and Account Information

We reserve the right to refuse any order you place with us. You agree to provide complete and accurate purchase and account information, and to promptly update your details to ensure successful transactions.

Section 7 – Shipments and Delivery

Shipping and handling charges will be specified during the ordering process. Title and risk of loss pass to you upon delivery of the products to the carrier. Delivery dates are estimates only and are not guaranteed. For electronic products, delivery is deemed to have occurred when the product is transmitted via email or made available for download.

Section 8 – Returns and Refunds

The Choyo Company Return Policy – Your satisfaction is our priority. If there is an issue with your order, notify us within 30 days of receipt.

Non‑Returnable Items: Personalized or branded items cannot be returned unless there is a manufacturing defect. Once your logo, design, or imprint is applied, the product is final and non‑returnable.

Pre‑Production Changes and Cancellations: You may cancel your order before it enters production. After you approve a visual proof, cancellations and refunds are not available.

Restocking Fees for Non‑Custom Items: Blank, non‑customized items may be returned, subject to a restocking fee of 10% to 30% based on our supplier’s policy. Fees will be disclosed before processing your return.

Return Authorization (RMA): You must obtain a Return Authorization Number (RMA) from Customer Service. Returns without an RMA will not be accepted.

Shipping for Returns: If items arrive damaged, defective, or misprinted due to our error, we will cover return shipping and offer a replacement or refund. For other returns, shipping costs are non‑refundable.

Condition of Returned Items: Items must be in original, unused, and resalable condition.

Refund Processing: Refunds are issued after we receive and inspect the returned items. Refunds will be made to the original payment method. Please allow 2–3 weeks for processing after the return is confirmed. Shipping costs are non‑refundable, and restocking fees may apply.

Custom Orders: Not eligible for return, refund, or exchange unless there is a manufacturing defect.

International Orders: All transactions are processed in USD. Refunds will also be issued in USD; we are not responsible for currency conversion rates applied by your payment provider.

Inspection Period: Inspect your order for defects, color discrepancies, or quantity errors upon arrival. Any concerns must be raised within 30 days of receipt. Delays caused by shipping carriers may affect refund timelines.

Section 9 – Custom Orders

By uploading designs for custom orders, you affirm that you own or have the right to use such designs, and you grant The Choyo Company a non‑exclusive, royalty‑free license to reproduce and use the designs for production and marketing purposes. You agree to indemnify The Choyo Company against any claims arising from the use of your designs. Custom orders are final sale and non‑returnable, except as provided in Section 8 for manufacturing defects.

Section 10 – User Feedback and Submissions

Any submissions, comments, or suggestions you provide may be used by The Choyo Company without restriction or obligation to compensate you. You agree not to submit any unlawful, offensive, or harmful material.

Section 11 – Prohibited Uses

You are prohibited from using the site for any unlawful purpose; to solicit others to perform or participate in unlawful acts; to violate any laws, regulations, or intellectual property rights; to harass, abuse, defraud, or harm others; or to upload any viruses or malicious code. We reserve the right to terminate your access for any violation.

Section 12 – Site Content and Intellectual Property

This site contains content owned by The Choyo Company or its licensors. You may not copy, modify, distribute, or use any part of the site content except as permitted by these Terms.

Designs created using our design tools: You retain ownership of your original design elements. However, by using our tools, you grant The Choyo Company a non‑exclusive, perpetual license to use, reproduce, and display the final composite design for operational, promotional, and portfolio purposes. The Company does not claim ownership of your underlying artwork.

Section 13 – Disclaimer of Warranties

THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error‑free, or secure. Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you.

Section 14 – Indemnification

You agree to indemnify, defend, and hold harmless The Choyo Company and its affiliates, officers, directors, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your use of the Service, your violation of these Terms, or your infringement of any third‑party rights.

Section 15 – Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CHOYO COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OUR SITE, PRODUCTS, OR SERVICES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Section 16 – Entire Agreement

These Terms constitute the entire agreement between you and The Choyo Company and supersede all prior agreements, understandings, or representations.

Section 17 – Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles.

Section 18 – Changes to Terms

We reserve the right to update or modify these Terms at any time by posting the revised version on this site. Your continued use of the site after any such change constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

Section 19 – Additional Terms

Additional terms may apply to specific features, promotions, or services offered on this site. Those terms will be presented to you at the time of use and are incorporated into these Terms by reference.

Section 20 – Dispute Resolution (Binding Arbitration)

Any dispute arising out of or relating to these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If not resolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, to be held in Multnomah County, Oregon. Judgment on the arbitration award may be entered in any court of competent jurisdiction. You agree to bring any claims in your individual capacity and not as a class action.

Section 21 – Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, pandemics, supplier failures, or governmental actions.

Section 22 – Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

We reserve the right to update these terms at any time. Continued use of the website constitutes your acceptance of any changes.
